Surety Bonds for Suppliers of Durable Medical Equipment, Prosthetics,
Orthotics and Supplies

Recently, the Centers for Medicare & Medicaid Services (CMS) announced
regulations requiring suppliers of certain durable medical equipment,
prosthetics, orthotics, and supplies (DMEPOS) to post a surety bond as a
condition of new or continued Medicare enrollment. The regulation states
that beginning May 4, 2009 suppliers seeking to enroll as a new applicant,
adding an additional practice location, or changing the ownership of a
DMEPOS supplier must submit a $50,000 surety bond to obtain Medicare
billing privileges.  Existing DMEPOS suppliers must submit to the NSC a
$50,000 surety bond for each assigned NPI beginning on October 2, 2009 to
maintain Medicare billing privileges.
Updated questions and answers are posted in the Surety Bond  FAQs on the
NSC web site and will continue to be updated as additional information
becomes available.

CMN Rejections for Replacement Items: CIGNA Government Services has received multiple inquiries regarding CMN's rejecting with edit 3031, INIT DATE<PREV END DATE. This may occur when billing for replacement items.
The CMN submitted overlaps a previous CMN on file. There are internal controls in place to manually set up the CMN when the RA modifier is appended to the procedure code and a narrative is submitted.

New Mailing Address for ADMC Requests Effective immediately, Advance Determination of Medicare Coverage (ADMC) requests need to be mailed to a new address.  The new mailing address is: National Government Services, Inc.Attn: Medical Review – ADMCPO Box 7018Indianapolis, IN  46207-7018 ADMC requests may also be sent via fax.  The fax number to submit an ADMC request is 317-595-4759.  ADMC requests cannot be submitted electronically. When submitting an ADMC request either by mail or fax, please include the Jurisdiction B DME MAC Advance Determination of Medicare Coverage Request Form (effective for use on or after February 18, 2008) with each request. Just as a reminder, upon receipt of an ADMC request, the DME MAC Medical Review Department will make a determination within 30-calendar days.  Please do not submit duplicate request during this time.  This will help reduce the time, cost and number of duplicate rejections we are processing. The Jurisdiction B DME MAC Supplier Manual, Chapter 9, will be updated with the new mailing address in June with the release of our June supplier manual revisions.  To view the supplier manual, please visit our Web site at www.NGSMedicare.com.

Two articles have been developed to provide guidance on the Overpayment process. Attention: Oxygen Suppliers This is a reminder for suppliers receiving a CO - 176 denial (Prescription is not current) or CO - 173 (Service was not prescribed by a physician) that these claims should be resubmitted with the correct information instead of requesting an appeal.  The appeal process is timely and costly to both you as a supplier and to National Government Services as a contractor.  If the recertification Certificate of Medical Necessity (CMN) or original CMN was omitted from the original claim submission, suppliers are encouraged to simply resubmit the claim with the CMN or recertification CMN to expedite processing of the claim. Suppliers are also encouraged to obtain CMN status information by contacting the Interactive Voice Response (IVR) system at 1-877-299-7900. For those individuals using the Express Plus software, instructions on how to enter initial and/or recertification CMNs can be found in the Express Plus manual on the CEDI Web site: http://www.ngscedi.com/downloads/CEDIExpressPlusManual.pdf As a reminder to suppliers, the documentation requirements for Oxygen CMNs can be found in the Local Coverage Determination (LCD) and Policy Article located on the National Government Services Web site at: www.NGSMedicare.com, click on Coverage, then click on Local Coverage Determination.

Jurisdiction B News: New Online Claim Status Inquiry Form

 
 
 
 
New Online Claim Status Inquiry Form        Beginning May 1, 2009, National Government Services will have a new online Claim Status Inquiry (CSI) enrollment form for Durable Medical Equipment Medicare Administrative Contractor (DME MAC) suppliers.  The CSI form will still be accessed from the National Government Services Web site at www.NGSMedicare.com.  However, it will be completed online and submitted electronically.  This enhancement to an online form will allow for more accurate submissions by our Trading Partners as critical fields on the forms, such as the NPI number and demographic information, will be required. After completing online, all CSI forms must be signed and faxed to National Government Services to meet the Centers for Medicare & Medicaid (CMS) and Electronic Data Interchange (EDI) verification and audit requirements.  By submitting the form online, EDI will be able to more accurately track the status of enrollment requests and prevent forms from being returned for missing or invalid information.  Note: The CSI enrollment form will no longer request the name of the Network Service Vendor the supplier will use, but having a Network Service Vendor to access CSI is still required.

New Rental Periods for Oxygen Equipment - Billing Reminders

NAS is seeing claims billed incorrectly when starting a new rental period for oxygen equipment. Claims for the replacement of oxygen equipment for the first month of use only are billed using the HCPCS code for the new equipment and either the RA or RP modifier depending on the date that the equipment is furnished. The RA modifier is used when replacing equipment on/after January 1, 2009, whereas the RP modifier is used for equipment replaced before January 1, 2009.

Time is running out for suppliers of durable medical equipment, prosthetics, orthotics and supplies (DMEPOS) who bill Medicare under Part B to obtain accreditation by the September 30, 2009 deadline or risk having their Medicare Part B billing privileges revoked on October 1, 2009.&nbsp;
CSI Medicare System Security Quarterly Review

In accordance with CMS, NAS is required to perform a periodic review of system access for all Claims Status Inquiry (CSI) users. During the month of April and October each provider will be faxed a listing of their active users. It is the responsibility of the facility contact person to respond to the user CSI listing. Failure to respond within the allotted timeframe will result in removal of access for all users.
Statement on DMEPOS Competitive Bidding Program

The Medicare Improvements for Patients and Providers Act of 2008 (MIPPA), enacted on July 15, 2008, made limited changes to the competitive bidding program for DMEPOS, including a requirement that the Secretary conduct a second competition to select suppliers for Round 1 in 2009. CMS issued an interim final rule with comment period (IFC) on January 16, 2009. The rule incorporates into existing regulations specific statutory requirements contained in MIPPA related to the competitive bidding program.

CMS will be offering several informational sessions on the Recovery Audit Contractor (RAC) Program. Presenting with CMS will be the RAC for California, HealthDataInsights, Inc. DMEPOS Supplier Accreditation - Time is Running OutDeadline is September 30, 2009 Time is running out for suppliers of durable medical equipment, prosthetics, orthotics and supplies (DMEPOS) who bill Medicare under Part B to obtain accreditation by the September 30, 2009 deadline or risk having their Medicare Part B billing privileges revoked on October 1, 2009.  A new MLN Matters Special Edition article on this subject is now available.  This article outlines what you need to do if you have not yet complied with the Medicare Program's supplier and quality standards to become accredited.  To view the article on the CMS website, go to:  http://www.cms.hhs.gov/MLNMattersArticles/downloads/SE0903.pdf. While the accreditation process takes on average 6-7 months to complete, the process could take as long as 9 months to complete.  Accordingly, DMEPOS suppliers should contact an accreditation organization right away to obtain information about the accreditation process and submit an application. In order to retain or obtain a Medicare Part B billing number, all DMEPOS suppliers (except for exempted professionals and other persons as specified by the Secretary) must comply with the Medicare program's supplier standards and quality standards to become accredited. The accreditation requirement applies to suppliers of durable medical equipment, medical supplies, home dialysis supplies and equipment, therapeutic shoes, parenteral/enteral nutrition, transfusion medicine and prosthetic devices, and prosthetics and orthotics.  Pharmacies, pedorthists, mastectomy fitters, orthopedic fitters/technicians and athletic trainers must also meetthe September 30, 2009 deadline for DMEPOS accreditation. Certain eligible professionals and other persons as specified by the Secretary are exempt from the accreditation requirement.  Further information on the DMEPOS accreditation requirements along with a list of the accreditation organizations and those professionals and other persons exempted from accreditation may be found at the CMS website: http://www.cms.hhs.gov/MedicareProviderSupEnroll/03_DeemedAccreditationOrganizations.asp.
