Question #20 Revision - Question & Answer (Q&A) documentJurisdiction B Durable Medical EquipmentMedicare Administrative Contractor (DME MAC)March 31, 2009 Small SupplierAsk-the-Contractor Teleconference (ACT) The answer to question #20 on the Q&A document from the March 31, 2009 Small Supplier Ask-the-Contractor Teleconference has been revised as follows: 20.  Are optometrists exempt from the surety bond requirement?Yes, optometrists are classified as physicians.  Per the CMS final rule titled Medicare Program: Surety Bond Requirements for Suppliers of Durable Medical Equipment, Prosthetics, Orthotics and Supplies (DMEPOS) published in the Federal Register on January 2, 2009, physicians and non-physician practitioners are exempt from the bonding requirement if the DMEPOS items are furnished only to his or her patients as part of his or her professional service. As a reminder, all other existing DMEPOS suppliers are required to submit a copy of their surety bond(s) to the National Supplier Clearinghouse (NSC) by October 2, 2009. All suppliers with pending applications or who are in the process of submitting an initial enrollment application to enroll in the Medicare Program for the first time, submitting to establish a new practice location, or an enrollment application to change the ownership of an existing supplier are required to obtain and submit a copy of the required surety bond to the NSC with the CMS-855S enrollment application no later than May 4, 2009.
